The Sandals Foundation is a charity whose role is to raise funds and work on projects to assist in a number of welfare and sustainability projects in the Caribbean and around the world.

Unique Caribbean Holidays Limited (“Unique”) is the EU representative for the Sandals Foundation. Unique is committed to protecting your privacy and this Privacy Notice sets out what personal data we collect, how we collect it, what we use it for and who we share it with.

By “personal data” we mean information about you which could identify you such as your name and contact details and your donation history. Personal data does not include data where you can no longer be identified from it such as anonymised aggregate data.

For the purposes of data protection legislation, Unique is considered the “data controller” of personal data processed in connection with this Privacy Notice. This means that Unique is responsible for deciding how Unique on behalf of the Sandals Foundation holds and uses personal data about you. This Privacy Notice applies to personal data about you that we collect, use and otherwise process in connection with your relationship with the Sandals Foundation as a donor or potential donor or volunteer in one of our community projects or voluntourism tours, including when you use our website sandalsfoundation.org or donate through third parties such as travel agents and tour operators, or engage with the Sandals Foundation at a Charity fair or Trade event we are attending.

Where you provide us with personal data of others, for instance, making a donation on behalf of or in the name of a friend(s) or relatives please provide those persons with a copy of this Privacy Notice.

What information do we collect about you and what do we use it for?

The types of personal data about you we may collect, store and use are set out in the table below and in each case we have specified what we use it for and our ‘lawful basis’ for processing it. The law specifies certain ‘lawful bases’ under which we are allowed to use your personal data. Most commonly, we will rely on one or more of the following lawful bases for processing your personal data:

  2. Where it is necessary for our legitimate interests and your interests and fundamental rights do not override those interests;

Processing is necessary for the purposes of our legitimate interests to define donors for our community projects/services, to keep our website updated and relevant, to develop our programs and to inform our Community Projects

Special categories of personal data

Certain categories of personal data, such as race, religion or health, are considered to be “special categories” of personal data as they are more sensitive types of data. We try to limit the circumstances where we process special categories of personal data as much as possible, however, we may also occasionally collect, store and use the special categories of personal data set out in the table below.

“Special categories” of more sensitive personal data require higher levels of protection whereby we need to have further justification for collecting, storing and using this type of personal data. We may process special categories of personal data with your explicit consent. Less commonly, we may process this type of information where it is needed in relation to legal claims.

You may also have made other requests in relation to your involvement in a community project or voluntourism tour/program that may contain or suggest some details about you that could be data special category of data. For instance, if applicable, you may request that special meals are available to you in the community project site or voluntourism tour, which could imply or suggest that you hold particular religious beliefs or have a particular medical condition.

By providing us with special categories of personal data you explicitly consent to our collecting, using and sharing this information with third parties and transferring such data outside of the EU as described in this Privacy Notice. We do not require you to provide us with special categories of personal data, however, if you do not do so we are unlikely to be able to accommodate your needs. Similarly, if you withdraw your consent (see Right to withdraw consent below) we are unlikely to be able to accommodate your needs.

Please note that we may use your personal data without your knowledge or consent, in compliance with the above rules, if we are required by law to do so or if we reasonably believe that it is necessary to protect our rights and/or to comply with judicial or regulatory proceedings, a court order or other legal process.

What if you do not provide the personal data we request?

If you do not provide us with certain information when requested, we will not be able to process your donation.

Change of purpose

We will only use your personal data for the purposes for which we collected it (as identified above in the What we use this data for column), unless we reasonably consider that we need to use it for another reason which is compatible with the original purpose. If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

How do we collect this information?

We typically collect personal data about you when you donate to the Sandals Foundation (either directly from you or from our tour operators and travel agents), when you are involved in a community project or voluntourism tour/program and when you use our website. For example:

  • When you donate on the Sandals Foundation’s website (sandalsfoundation.org)
  • When you donate via a tour operator or travel agent
  • When you donate through Sandals call centres or customer care agents
  • When you donate through Sandals, Beaches or Grand Pineapple Resorts
  • When you donate through Island Routes Caribbean Adventure Tours (the tour provider company we use in the Caribbean)
  • If you choose to interact with us via social media
  • When you visit our website you may directly give us some personal data and we may also automatically collect certain data such as technical data about your equipment, browsing actions and patterns. We collect this personal data by using cookies, server logs and other similar technologies. Please see the below Cookies section for further details.
